Terms of Service

These Terms of Service ("Terms") govern your use of Position Technology (position999.com), operated by Position Technology Inc. By accessing the site or submitting a service request, you agree to these Terms.

1. Acceptance of terms

You must be at least 18 years old to submit a service request. We may update these Terms from time to time; the version published on this page at the time of your request applies to that engagement.

2. Service descriptions & pricing

We describe our cloud, advertising and web services and publish prices in US Dollars (USD) as accurately as we can; every engagement is invoiced in USD. Listed prices are starting points for a tailored quote — the price confirmed in writing when your consultant responds is the price that applies to your engagement. Ad spend paid to advertising platforms is separate from our service fees. If we discover a pricing error on your request, we will contact you before starting work to confirm or cancel.

3. Requests & payment

Submitting a request through the site creates an enquiry, not a binding contract. The engagement is formed when we confirm a written proposal and you accept it. Payment is arranged offline by bank transfer: after you submit your request, a consultant will contact you with a tailored quote and invoice, and no charge is made online at any point. We may decline a request where scope, pricing or fit is unclear, or we suspect misuse.

4. Onboarding & service delivery

Once your request is confirmed, we schedule a kickoff, agree the delivery timeline and begin work — typically within a few business days of payment confirmation. Full details are on our Service Delivery Process page.

5. Refunds

Services that have not started can be cancelled for a full refund; engagements in progress are refunded for the unstarted portion. Full conditions, procedures and exceptions are set out in our Refund Policy, which forms part of these Terms.

6. Service levels

Managed engagements are covered by the commitments described on our Service SLA page, including response times, availability targets and monthly reporting. Nothing in these Terms limits any statutory rights that cannot be excluded.

7. Custom & multi-service engagements

Businesses can request custom scopes, bundled plans and monthly service agreements by contacting info@position999.com. Written quotes are valid for 30 days from the date issued.

8. Accounts

You are responsible for keeping your login details confidential and for activity under your account. Notify us promptly if you suspect unauthorised use.

9. Intellectual property

All content on the site — text, images, logos and design — is owned by or licensed to Position Technology Inc and may not be reused without written permission. Work products created for you under an engagement are transferred to you on full payment, except for our internal tooling and templates.

10. Limitation of liability

To the fullest extent permitted by law, our liability for any claim arising from an engagement is limited to the service fees you paid for the relevant engagement. We are not liable for indirect or consequential loss, or for outages of third-party cloud and advertising platforms. Nothing in these Terms excludes liability for fraud or any other liability that cannot be excluded.
